So, morality stands as a matter of law. Under which law should we be governed? When we are governed by morality and fraud, who should we follow? The Constitution of India or the Constitution of India is supreme. On this basis, morality stands as a matter of law.”The government, the apex court said, not only got rid of its moral responsibility to do the right thing, but was also guilty of “illegal behaviour” because the deal with Unitech lacked legal standing.The court said that an undertaking made by the Centre is subject to the law of the land, and not by the government’s counsel. “There is no power of attorney of the counsel. The counsel is liable under the same law. In the circumstances of this case, this is a fraud on the Constitution of India. The minister of law and justice is bound under law. It was only in the name of morality that he was so led. There was no power of attorney for the minister. When he went beyond his brief, he should have had an order of caution, but he was prepared to do what he did. As the counsel is the minister’s officer and is bound by the law, so he should have followed the law,” the court said.The apex court made it clear that the counsel was liable to pay the exemplary damages under the law, since he had gone beyond his brief.The court passed a slew of orders and observations on how the then PM Manmohan Singh
