The monument association’s lawyers argued that the organization would suffer irreparable harm if the 45th Congress passes a law preventing the memorial from being used for fundraising purposes, as the Senate has already voted to do.
The Senate, which did not vote on the measure, said it expects the executive branch to honor park regulations. The White House said in a statement on Wednesday that the memorial is “nonetheless available for all appropriate private fundraising.”
The association had sued to stop the law from going into effect, but a judge dismissed the suit last year on grounds that the group had not demonstrated a likelihood of winning its case. The organization then appealed to the Washington, D.C., Court of Appeals.
The justices of the District of Columbia circuit ruled unanimously in favor of the Senate on Wednesday.
“It is certainly a great relief to us,” Mark Emerson, the association’s legal director, said of the decision.
“It was always our position that the World War II Memorial is a national monument, and the fight to preserve that was never about fundraising,” he said. “The Senate had a monopoly on fundraising events at the memorial, and the association wanted the Senate to allow others to engage in fundraising.”
A panel of the D.C. circuit heard the case in May and issued its ruling Wednesday. Emerson said he believed the judges were swayed by the Senate’s arguments, which focused on the memorial’s designation as a national monument.
U.S. District Court Judge William Quarles Jr. had rejected the association’s arguments, contending that the monument was not “fully within” the National Park Service’s jurisdiction in 1984, when Congress declared it a national memorial.
The association says that the National Park Service shouldn’t be able to restrict uses of the memorial under the Antiquities Act,
